By accessing or using Bidrails ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Service Description

Bidrails is a quote pipeline management tool for contractors. The Service allows you to create, send, track, and manage quotes for your customers, including follow-up reminders, analytics, and team collaboration features.

3. Account Responsibilities

• You must provide accurate and complete registration information.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately if you suspect unauthorized access to your account.
• You must be at least 18 years old to use the Service.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload or transmit malicious code, spam, or harmful content
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or other users' experience
• Scrape, crawl, or use automated tools to extract data from the Service
• Resell or redistribute the Service without our written consent

5. Payment Terms

Bidrails offers free and paid subscription plans. For paid plans:

• Subscriptions are billed monthly or annually, depending on your chosen plan.
• Payment is due at the start of each billing cycle.
• You may upgrade, downgrade, or cancel your plan at any time. Changes take effect at the next billing cycle.
• Refunds are handled on a case-by-case basis. Contact support for assistance.
• We reserve the right to change pricing with 30 days' notice.

6. Intellectual Property

The Service, including its design, code, logos, and content, is owned by Bidrails and protected by intellectual property laws. You retain ownership of any data you upload to the Service. By using the Service, you grant us a limited license to store, process, and display your data solely to provide the Service.

7. Limitation of Liability

To the fullest extent permitted by law:

• The Service is provided "as is" and "as available" without warranties of any kind.
• We do not guarantee that the Service will be uninterrupted, error-free, or secure.
• We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Termination

You may terminate your account at any time by contacting support or using the account deletion feature. We may suspend or terminate your account if you violate these Terms or engage in activity that harms the Service or other users. Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation first, then through binding arbitration or the courts of competent jurisdiction.
